Please read these terms carefully before using our website.
Who we are
Probability AI ("Probability AI", "we", "us") operates this website. We are an early-stage project operating from Germany, not yet a registered company, and not commercially active: this website supports a private alpha limited to invited testers.
Questions about these terms, or about anything on this website, can be sent to info@probabilitylabs.ai.
About these terms
These terms govern your access to this website and everything available on it (the "Site"). By using the Site you agree to them. If you do not agree, please do not use the Site.
These terms cover the Site only. Any product, pilot or service we provide to you is governed by a separate written agreement, and where that agreement conflicts with these terms, the agreement prevails.
What this website is, and what it is not
This Site describes what Probability AI is building. It is a marketing and information website.
The Site is not an offer capable of acceptance, and nothing on it forms a contract for the supply of software or services. Descriptions of the platform, including any figures, screenshots or examples, are illustrative. They do not promise that any particular feature will be available to you, or that any particular result will be achieved.
Access to our platform is by invitation only, is currently free of charge, and is not open to the general public.
Permitted use
You may use the Site only for lawful purposes and in the ways these terms allow. You agree not to:
- use the Site for any unlawful, fraudulent or misleading purpose;
- attempt to gain unauthorised access to the Site, to our systems, or to any account or data that is not yours;
- introduce any virus, worm, malware or other harmful code;
- interfere with or disrupt the Site or the networks and servers that make it available;
- copy, reproduce, scrape, mirror or index the Site by automated means, except where a search engine follows our robots.txt;
- remove or obscure any copyright, trade mark or other proprietary notice;
- use the Site in a way that restricts anyone else's use of it.
We may suspend or withdraw your access to the Site if we reasonably believe you have breached these terms.
Information you send us
If you send us information through the contact form or by email, you confirm that it is accurate and that you are entitled to send it to us.
How we handle personal data is set out in our Privacy Policy, which forms part of these terms.
If you send us ideas, suggestions or feedback about our platform, you agree that we may use them freely and without obligation to you. You keep ownership of what you send, and you do not need to send us anything confidential through this Site.
Intellectual property
The Site, and everything on it — text, design, graphics, code and the Probability AI name and marks — belongs to us or our licensors and is protected by intellectual property law.
You may view and use the Site for its intended purpose. We grant you no other rights, and in particular no right to copy, modify, distribute or commercially exploit the Site or its content.
Availability, changes and termination
The Site is provided free of charge and we do not guarantee that it will always be available or uninterrupted. We may change, suspend or withdraw the Site, or any part of it, at any time and without notice.
Alpha software
Any access we give you to our platform is currently an alpha or private beta. It is pre-release, may contain errors, and may change or be withdrawn at any time. It is not intended for production use or for decisions that require guaranteed accuracy, and it must not be relied on as the sole basis for a business decision.
No warranties
The Site is provided "as is" and "as available". To the extent the law allows, we give no warranties, conditions or guarantees about it, including about accuracy, completeness, fitness for a particular purpose or non-infringement.
Nothing in these terms excludes or limits any warranty or right that the law does not allow us to exclude or limit. If you are a consumer, your statutory rights remain unaffected.
Limitation of liability
Nothing in these terms limits our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be limited by law.
To the extent the law allows, we are not liable for loss of profit, loss of business, loss of data, or any indirect or consequential loss arising out of your use of, or inability to use, the Site.
Because the Site is provided free of charge, our total liability in connection with it is limited accordingly, except where the law does not permit that limitation.
Indemnity
If you use the Site in breach of these terms and that causes us loss or leads to a claim against us, you agree to compensate us for that loss or claim, to the extent the law allows.
Governing law and jurisdiction
These terms are governed by the law of the Federal Republic of Germany.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in the courts of that country.
If you are a business, the courts at our registered seat have exclusive jurisdiction. Where we are not yet registered, the courts at our place of business apply.
Changes to these terms
We may update these terms as the Site and our project evolve — for example when we complete our company registration or launch a paid service. The version published on this page is the version that applies, and the date at the top shows when it last changed.
